§ 2-01. Composition, qualifications, election and forfeiture.

  • A.

    The legislative power of Berwick shall be vested in a council consisting of five (5) members elected at large for four (4) year terms.

    B.

    A council member who has served more than two and one-half (2½) terms in three (3) consecutive terms shall not be eligible to qualify as a candidate for council member for the succeeding term. This term limitation shall (a) become effective at the first election for a full term following adoption of this charter, and (b) apply only prospectively to the incumbent council members if the charter is approved by the electors during their term of office.

    C.

    A council member shall be a qualified elector of the municipality at the time of qualification.

    D.

    A council member shall have been legally domiciled in Berwick for at least one (1) year immediately preceding the time established by law for qualifying for council office.

    E.

    A council member shall continue to be legally domiciled in Berwick during the term of office. Should the legal domicile of a council member change from Berwick, that office shall automatically become vacant, and declared such by the council, which vacancy shall be filled as provided in the section on "Vacancies."

    F.

    A council member shall automatically forfeit the office if such member during the term of office lacks any qualification for the office prescribed by this charter.
