§ 10-18. Definitions; specifications.

  • (a)

    Garbage cans, according to the definition of this article, shall be any can, container or receptacle manufactured for the purpose of holding garbage, that no garbage can have a capacity of less than ten (10) gallons, nor more than thirty-five (35) gallons, for residential and some small business use; collectomatic containers of one- or two-cubic-yard capacity for large commercial businesses, residences, institutions, schools, apartment complexes, that they will be provided with a lid or lids which will at all times fit tightly and exclude rainwater and flies and other insects; [and] that all garbage cans and containers be of metal or plastic or of a type approved by the mayor and councilmen of the town. The use of lard cans, tubs, and other such containers other than regular garbage cans and collectomatic containers for the purpose of holding garbage is hereby prohibited.

    (b)

    Plastic and/or paper bags, according to this article, shall be any bags that are manufactured and sold for the purposes of holding garbage and/or trash, that no bag will have a capacity of more than thirty (30) gallons and shall be of a type approved by the mayor and councilmen of Berwick. All such bags that are put out for collections shall be tied tightly to exclude rainwater, flies, and insects.

    (c)

    Garbage, in the interpretation of this article, shall mean food scraps, table refuse, spoiled fruits, vegetables, and animal products, or other waste materials produced from the preparation serving, sale, or distribution of food.

    (d)

    Trash, in the interpretation of this article, shall mean leaves, grass, boxes, tin cans, litter, etc.
