§ 18-41. Penalty.

Any water customer who fails to follow the Louisiana State Plumbing Code or to comply with section 18-40 above stated shall be subject to the following penalties:

(a)

Water service to the premises shall be disconnected without notice or legal proceeding being required, and shall remain disconnected until compliance with the Louisiana State Plumbing Code and with section 18-40 above stated; and/or

(b)

Punished by a fine not exceeding five hundred dollars ($500.00); and/or

(c)

Imprisonment for a term not exceeding sixty (60) days.

Penalties (b) and (c) shall be enforced through proceedings in the mayor's court of the Town of Berwick.

All other ordinances, or parts of ordinances, in conflict with this section are hereby repealed.

Should any section, paragraph, sentence, clause or phrase be declared unconstitutional, invalid, or repealed for any reason, the remainder of the section shall not be affected. All provisions of this section are declared to be severable and the invalidity of any part of this section shall not affect other provisions, items or applications of this section which can be given effect without the invalid provisions, items, or applications of this section.
