§ 4-59. Penalty.

  • (a)

    First offense. Any person found guilty of first offense of violating any of the provisions of this article shall be fined not less than two hundred dollars ($200.00) and not more than five hundred dollars ($500.00), be imprisoned for not more than thirty (30) days, or both.

    (b)

    Second offense. Any person found guilty of second offense of violating any of the provisions of this article shall be fined not less than four hundred dollars ($400.00) and not more than five hundred dollars ($500.00), be imprisoned for not more than forty-five (45) days, or both.

    (c)

    Third offense. Any person found guilty of third offense of violating any of the provisions of this article shall be fined five hundred dollars ($500.00), be imprisoned for not more than sixty (60) days, or both.

    Additionally, for any violation, upon order of the court, the small animal warden, for the safety of any person, shall impound a vicious dog pending compliance by the owner with the provisions of this article and pending compliance with any penalty imposed for violation of this article. This provision shall mandatorily be ordered when a vicious dog has attacked a human being or has attempted an attack on a human being. The owner or keeper of the dog shall be responsible for all charges and costs for the impoundment.
