§ 5-20. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Building or structure means, where appropriate, a building or part of a building, mechanical or electrical installations or equipment, chimneys, staging or other structures. The word structure shall specifically include mobile home units, manufactured home and manufactured housing that are factory-built, and include any residential dwelling unit that are on a chassis even if not factory-built.

    Unsafe, dangerous, dilapidated and abandoned building or unsafe structure includes the following buildings or structures:

    (1)

    Those whose walls or other structural members sag, list, lean or buckle to such an extent that they are in danger of collapse;

    (2)

    Those with structural members which are overloaded or which have insufficient strength to be safe for the purpose used;

    (3)

    Those damaged by fire, wind, deterioration or other causes to such an extent that they are dangerous to the general health or safety of the occupants or the public;

    (4)

    Those which are vacant, and unguarded and open at doors or windows or which otherwise provide unrestricted access to the interior;

    (5)

    Those having light, air or sanitation facilities, which are inadequate to protect the general health or safety of the occupants;

    (6)

    Those not having exits or fire protection required by the building code or the fire prevention code of the town;

    (7)

    Those having any piece, part or attachment which is so insecurely fixed as to be in danger of falling or being dislodged by the elements so that it may injure any person or property;

    (8)

    Those which are in violation of the building code, electrical code, or plumbing code of the town;

    (9)

    Those of unfinished construction for which the building permit has expired;

    (10)

    Those which constitute a fire or windstorm hazard;

    (11)

    Those which have become or are so dilapidated, decayed, unsafe, unsanitary or which so utterly fail to provide the amenities essential to decent living that they are unfit for human habitation or are likely to cause sickness or disease, so as to work injury to the health, morals, safety or general welfare of those persons living in them; or

    (12)

    The remains, debris, walls, chimneys or floors of, or left from, a building or structure which has partially or completely collapsed, fallen or been torn down.

    (13)

    Any building or structure that has been abandoned. "Abandoned" means property that is vacant or not lawfully occupied. The term "vacant or not lawfully occupied" shall include but shall not be limited to any premises which are not actually occupied by its owner, lessee, or other invitee or if occupied, without utilities, and has been left unsecured or inadequately secured from unauthorized entry to the extent that the premises could be entered and utilized by vagrants or other uninvited persons as a place of harborage or any premises which by reason of dilapidation, deterioration, state of disrepair, or other such status is otherwise detrimental to or endangers the public safety, health, or welfare.
