§ 13-41. Loud radio, music, etc. from motor vehicle.

  • (a)

    The unnecessary loud playing, use or operation of any radio, musical instrument, phonograph, tape player, compact disk player, or any other device for the production or reproduction of sound while in and/or operating a motor vehicle is hereby declared to be a nuisance and unlawful.

    (b)

    The operation of any radio, musical instrument, phonograph, tape player, compact disk player, or any other device for the production or reproduction of sound while in and/or operating a motor vehicle in such a manner as to be audible at a distance of fifty (50) feet from the vehicle in which it is located shall be prima facie evidence of a violation of this section.

    (c)

    Exempted from the provision of this section are duly authorized mechanical loud speakers mounted on a moving vehicle as temporarily authorized by the town for a specific occasion in compliance with town ordinances and other legitimate functions as licensed by the town.

    (d)

    A violation of this section shall be punishable by a fine of not less than fifty dollars ($50.00) and not more than five hundred dollars ($500.00) and/or up to ten (10) days in jail, and each citation which occurs shall constitute a separate violation of this section.
